''Ervaren probleem''<br/>De regeling ‘declaratiebepalingen DBC's in de curatieve GGZ’ schrijft sinds 2013 voor wie hoofdbehandelaar mag zijn. Over 2012 en eerder waren er nog geen publieke eisen. Over 2013 geldt als eis dat de hoofdbehandelaar een beroep moet hebben dat opgenomen is in het BIG-register, en bevoegd en bekwaam moet zijn om cliënten te classificeren volgens de systematiek van de DSM-IV-TR. Ook moet de hoofdbehandelaar vanaf 2013 direct cliëntgebonden tijd hebben besteed aan de cliënt waarvoor wordt gedeclareerd. Over 2014 is het beroep van de hoofdbehandelaar verscherpt naar een gelimiteerde set van elf beroepen, waarvan twee specifiek voor dyslexiezorg. Verzekeraars hebben deze regels geoperationaliseerd in de modelovereenkomst en in de contracten met zorgaanbieders. In de praktijk zijn situaties ontstaan waarin het beroep van de hoofdbehandelaar niet aansluit bij de gemaakte contractafspraken. De vraag is of de verzekeraar deze behandelingen wel mag vergoeden.

''Uitwerking NZa''<br/>Als zorgaanbieders en zorgverzekeraars ervoor kiezen om over 2013 nadere afspraken te maken die passen binnen de regels over wie hoofdbehandelaar mag zijn, dan is dat aan partijen. De NZa gaat niet over private afspraken tussen aanbieder en verzekeraar, maar houdt wel toezicht op naleving van wet- en regelgeving. Dit houdt concreet in dat de NZa vanuit haar toezichthoudende rol geen belemmering ziet als een verzekeraar een hoofdbehandelaar accepteert waarvan het beroep niet aansluit bij de eerder gemaakte contractafspraken. Voorwaarde is dat dit beroep aansluit bij de regeling ‘declaratiebepalingen DBC’s in de curatieve GGZ’ en dat de verzekeraar deze aanpassing publiceert.

De hoofdbehandelaars in de (gespecialiseerde GGZ) zijn BIG-geregistreerd en hebben een GGZ-specifieke opleiding gevolgd te weten: psychiater, klinisch psycholoog, klinisch neuropsycholoog, psychotherapeut, specialist ouderengeneeskunde, verslavingsarts in profielregister KNMG, klinisch geriater, verpleegkundig specialist GGZ en GZ-psycholoog. De Minister heeft deze beroepen aangewezen als hoofdbehandelaar&nbsp;(bron:&nbsp;<span style="line-height: 18.9090900421143px">BELEIDSREGEL BR/CU-5111 (p.2),&nbsp;</span>NADERE REGEL NR/CU-556&nbsp;(p.3)).


<br/>In de verschillende WMG-overeenkomsten zijn de volgende beroepen aangemerkt als bevoegd hoofdbehandelaar:
<span style="color:#FF0000">Mogelijkerwijs zijn er door ggz-instellingen met specifieke verzekeraars bij de inkoop afspraken gemaakt die afwijken van hetgeen hieronder genoemd is. Het is bijvoorbeeld mogelijk dat verzekeraars bepaalde beroepen in het geheel niet toestaan als hoofdbehandelaar. Indien er sprake is van afspraken met verzekeraars die strenger zijn dan de beleidsregels van de NZa wordt dat in de instellingsspecifieke bijlage bij het normenkader nader toegelicht, en wordt daar in de programmeerbare norm rekening mee gehouden.</span>

#Indien een regie-/hoofdbehandelaar met een bepaald beroep enkel binnen het deelgebied psychogeriatrische stoornissen mag functioneren als regie-/hoofdbehandelaar, is dit geïnterpreteerd als DBC's met een hoofddiagnose in de subcategorie "Dementie" (as1_2.02) óf wanneer de cliënt ten tijde van de start van de DBC ouder was dan 65 jaar.
#Indien een regie-/hoofdbehandelaar met een bepaald beroep enkel binnen het deelgebied verslavingszorg mag functioneren als regie-/hoofdbehandelaar, is dit geïnterpreteerd als DBC's met een hoofddiagnose in de hoofdcategorie "Aan een middel gebonden stoornissen" (as1_4).
#Indien een regie-/hoofdbehandelaar met een bepaald beroep enkel onder formele leiding van bijvoorbeeld een psychiater of klinisch psycholoog regie-/hoofdbehandelaar mag zijn (MDO-constructie), moet deze binnen de GGZ-instelling deelnemen aan een gestructureerd multidisciplinair overleg waarbij tenminste ook een behandelaar met een dergelijk beroep&nbsp;betrokken is en waarbinnen op casusniveau de differentiaal diagnostische mogelijkheden en de behandelmogelijkheden worden besproken. Op het niveau van de individuele cliënt wordt er gekeken of de betreffende regie-/hoofdbehandelaar gedurende de periode dat hij/zij regie-/hoofdbehandelaar van de DBC was tegelijkertijd met een behandelaar met een beroep uit onderstaande tabel de cliënt heeft gesproken, gebeld of gemaild (directe tijd), dan wel heeft besproken (indirecte tijd). Indien de MDO-constructie tijdens de looptijd van de DBC voor meerdere regie-/hoofdbehandelaars vereist is, moet er bij tenminste één van die regie-/hoofdbehandelaars sprake zijn geweest van een geldige MDO-constructie. In de verschillende WMG-overeenkomsten zijn de volgende beroepen aangemerkt als bevoegd regie-/hoofdbehandelaar:

Mogelijkerwijs zijn er door ggz-instellingen met specifieke verzekeraars in de WMG-overeenkomst afspraken gemaakt die afwijken van hetgeen hierboven genoemd is. Het is bijvoorbeeld mogelijk dat verzekeraars bepaalde beroepen in het geheel niet toestaan als hoofdbehandelaar. Indien er sprake is van afspraken met verzekeraars die strenger zijn dan de beleidsregels van de NZa wordt dat in de instellingsspecifieke bijlage bij het normenkader nader toegelicht, en wordt daar in de programmeerbare norm rekening mee gehouden.
