Besluit Zorgverzekering (2016):<br/>Artikel 2.4<br/>1 Geneeskundige zorg omvat zorg zoals huisartsen, medisch-specialisten, klinisch-psychologen en verloskundigen die plegen te bieden, zintuiglijk gehandicaptenzorg als bedoeld in artikel 2.5a, zorg bij stoppen-met-rokenprogramma als bedoeld in artikel 2.5b, geriatrische revalidatie als bedoeld in artikel 2.5c en paramedische zorg als bedoeld in artikel 2.6.
 
Artikel 2.6<br/>2 Fysiotherapie of oefentherapie omvat zorg zoals fysiotherapeuten en oefentherapeuten die plegen te bieden ter behandeling van de in bijlage 1 aangegeven aandoeningen, voor zover de daarbij aangegeven termijn niet is overschreden. Deze zorg omvat voor de verzekerden van achttien jaar en ouder niet de eerste twintig behandelingen.<br/>3 Fysiotherapie omvat tevens bekkenfysiotherapie in verband met urine-incontinentie. Deze zorg omvat voor de verzekerden van achttien jaar of ouder ten hoogste negen behandelingen.<br/>4 Voor verzekerden jonger dan achttien jaar bestaat fysiotherapie en oefentherapie in andere gevallen dan het tweede lid tevens uit ten hoogste negen behandelingen van dezelfde aandoening per kalenderjaar, bij ontoereikend resultaat te verlengen met ten hoogste negen behandelingen<br/>De aandoeningen in bijlage 1 van het besluit zorgverzekering betreffen aandoeningen aan het zenuwstelsel (lid a), aan het bewegingsapparaat (lid b) of een van de bij naam genoemde aandoeningen zoals in lid d benoemd. Artikel 2.12<br/>1 Verblijf omvat verblijf gedurende een onafgebroken periode van ten hoogste 1.095 dagen, dat medisch noodzakelijk is in verband met de geneeskundige zorg, bedoeld in artikel 2.4, of in verband met chirurgische tandheelkundige hulp van specialistische aard als bedoeld in artikel 2.7, al dan niet gepaard gaande met verpleging, verzorging of paramedische zorg.<br/>2 Een onderbreking van ten hoogste dertig dagen wordt niet als onderbreking beschouwd, maar deze dagen tellen niet mee voor de berekening van de 1.095 dagen.<br/>3 In afwijking van het tweede lid tellen onderbrekingen wegens weekend- en vakantieverlof mee voor de berekening van de 1.095 dagen.’
 
Geneeskundige Rapport (deel 1) (2012):<br/>5.c.2. Geneeskundige GGZ algemeen<br/>De geneeskundige GGZ omvat eerstelijns GGZ, specialistische GGZ en verblijf dat medisch noodzakelijk is in verband met geneeskundige zorg/specialistische GGZ (bijvoorbeeld verblijf in een psychiatrisch ziekenhuis of PAAZ). De geneeskundige GGZ bestaat uit<br/>• huisartsgeneeskundige zorg,<br/>• eerstelijnspsychologische zorg en<br/>• specialistische GGZ<br/>• farmaceutische zorg.
 
Verblijf in combinatie met geneeskundige GGZ kan ook verpleging, verzorging of paramedische zorg omvatten. Verpleging en verzorging in verband met een somatische aandoening valt hier ook onder. De paramedische zorg bij het verblijf is beperkt tot de zorg die nodig is in het kader van de behandeling waarvoor het verblijf medisch noodzakelijk is, in dit geval in verband met een psychische stoornis.

Het besluit zorgverzekering geeft aan dat fysiotherapie enkel voor de in bijlage 1 van het besluit benoemde aandoeningen deel uitmaakt van de Zvw, vanaf behandeling 21.<br/>Het geneeskundige rapport deel 1 beschrijft de elementen waar de geneeskundige GGZ uit bestaat. Alleen bij verblijf binnen de geneeskundige GGZ kan dit ook paramedische zorg, waar fysiotherapie onder valt (conform besluit zorgverzekering artikel 2.6), bevatten voor zover noodzakelijk in het kader van de behandeling van de psychische stoornis.
 
De tijd geregistreerd door behandelaren met de beroepscode 9925 (Fysiotherapeuten) en de tijd geregistreerd door andere behandelaren op de activiteiten voor fysiotherapie (act. 3.5.1 t/m 3.5.7) zijn conform het besluit zorgverzekering en het geneeskundige rapport niet passend binnen de ambulante GGZ.<br/>In 2016 is er sprake geweest van een bepaalde coulance, die wordt afgebouwd richting 2018. Voor 2017 geldt een signaleringsgrens van 5%.
 
Voor zorgaanbieders waarbij het gemiddelde percentage inzet fysiotherapie (gebaseerd op de controlemassa) boven de 5% uitkomt dienen alle DBC’s waarop directe en indirecte tijd is geschreven door fysiotherapeuten en/of tijd is geschreven op de activiteiten voor fysiotherapie te worden weergegeven in het rapportageformat.<br/>Voor die DBC’s waarbij dit minder dan 5% betreft ten opzichte van de totale tijd is vanuit coulance geen aanvullende toelichting benodigd. Deze worden niet afgekeurd.<br/>Bij DBC’s waar het percentage hoger ligt dan 5% geregistreerde tijd t.o.v. de totale tijd, moet worden toegelicht op de inhoud van de geleverde activiteit in relatie tot de psychische stoornis. Als fysiotherapie geen deel uitmaakt van de geneeskundige ggz behandeling wordt de bijbehorende tijd op de inzet van fysiotherapie in mindering gebracht op de minuten binnen de DBC.<br/>Als de inzet van de fysiotherapeut geen deel uitmaakt van de geneeskundige ggz behandeling wordt de bijbehorende tijd in mindering gebracht op de minuten binnen de DBC.
